Supreme Court Justice Kagan Delivers 9-0 Immigration Opinion

Supreme Court Associate Justice Elena Kagan wrote an opinion that yesterday delivered a unanimous rejection of an immigrant’s plea to ignore immigration law [2]. In Sanchez v Mayorkas [3], the plaintiff sought to create a loophole in immigration [4] law “that would allow thousands of illegal immigrants to become lawful permanent residents,” per reporting [5] by PJ media.

Jose Santos Sanchez, a citizen of El Salvador, entered the country illegally in 1997 and 1998, the case stated. His wife, Sonia Gonzalez, also entered twice illegally. They have four children and live in New Jersey, per reporting [6] by the Daily Mail.

In 2001, he applied for TPS or Temporary Protected Status. Kagan’s opinion states:

“Petitioner Jose Santos Sanchez entered this country unlawfully from El Salvador. Years later, because of unsafe living conditions in that country, the Government granted him Temporary Protected Status (TPS), entitling him to stay and work in the United States for as long as those conditions persist. Sanchez now wishes to become a lawful permanent resident (LPR) of the United States. The question here is whether the conferral of TPS enables him to obtain LPR status despite his unlawful entry. We hold that it does not.”
