Supreme Court Strikes Down 108-Year-Old NY Gun Law that Restricted Access to Concealed Carry Permits

We can only hope that they continue to claw back the American liberties taken from us by tyrannical elitists.  

The conservative Supreme Court justices selected by President Trump continue to uphold the Constitution and American liberty. In a 6-3 ruling this Thursday, the Supreme Court struck down a 108-year-old NY gun law that required “proper cause” to carry a concealed weapon.  

The 108-year-old gun law in question is the Sullivan Act. Via the Sullivan Act, New York infringed upon the right to bear arms by requiring applicants to show “proper cause” for seeking a license. Proper cause mandates that applicants provide reasons beyond protecting oneself and one’s property to obtain a carry permit. An individual who proves proper cause must show that they have a special need for a firearm that is “distinguishable from that of the general community.” 

Justice Clarence Thomas provided the majority opinion and condemned the Sullivan Act: 

“The exercise of other constitutional rights does not require individuals to demonstrate to government officers some special need. The Second Amendment right to carry arms in public for self-defense is no different. New York’s proper-cause requirement violates the Fourteenth Amendment by preventing law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms in public.” 

Justice Thomas’ opinion strikes at the heart of the issue and clearly condemns the Sullivan Act as unconstitutional. By restricting the right to bear arms only to individuals who can meet government officials’ vague and everchanging standards for proper cause, the Sullivan Act most seriously impacted average Americans who sought to protect themselves.  

In his concurring opinion, Kavanaugh stated: 

“New York’s outlier may-issue regime is constitutionally problematic because it grants open-ended discretion to licensing officials and authorizes licenses only for those applicants who can show some special need apart from self-defense.” 

Besides being unconstitutional, it is likely the Sullivan Act contributed in large part to the increased crime in New York’s inner-city communities. Criminals are emboldened to commit violent assaults when they know the law-abiding public is defenseless and unarmed due to state legislation. However, Democrats do not recognize this reality.  

In response to the Supreme Court’s decision, NYC mayor Eric Adams, who himself has a concealed carry permit, stated the following:  

“Today’s Supreme Court decision may have opened an additional river that is going to feed the sea of gun violence in our city and in our nation. We cannot allow New York to become the wild, wild West. That is unacceptable.” 

If Eric Adams truly believes that concealed carry permits increase gun violence in NYC, he should surely turn in his firearms and permits. Of course, Adams won’t do this. Tha’s because he’s an elitist who believes the government should decide who can and cannot carry a firearm to protect themselves.

The Sullivan Act was specifically crafted for elitists to own firearms and for the public to be defenseless. According to the law, the only New Yorkers that qualify for a concealed carry permit must have a greater need for self-protection from “that of the general community.” 

President Joe Biden also weighed in on the Supreme Court decision:  

“I am deeply disappointed by the Supreme Court’s ruling… The State of New York has required individuals who would like to carry a concealed weapon in public to show a need to do so for the purpose of self-defense and to acquire a license.” 

It never takes long for Joe Biden to begin lying. The beginning of his statement severely mischaracterizes the NY gun law, claiming that it only required the public to show a need for self-defense. The Sullivan Act is problematic because it requires more than just self-defense, a “proper cause” for obtaining a concealed carry permit.  

President Trump’s Supreme Court nominees have brought about another victory for American liberty by striking down NY’s unconstitutional gun law. We can only hope that they continue to claw back the American liberties taken from us by tyrannical elitists.
